A 6-08: Appeal of the Hearing Officer’s decision to deny the
request for a 0-foot setback exception for a deck in the rear and
side yards; R-1-PD zone; Mason Medizade, applicant.

Project planner James David presented the facts about the illegal
non-permitted deck that was constructed 9 feet high in required
setbacks and recommended the Planning Commission deny the appeal of
the Hearing Officer’s decision. Commissioners questioned staff on
site details, zoning code interpretations, and code enforcement
history. Mr. David and Code Enforcement Officer Gene Gailey
responded. The appellant, Mason Medizade, testified that the deck
construction was necessary due to damage from the San Simeon
earthquake and that the deck was structurally sound. The Commission
questioned the appellant about the rear property line, his design
rationale and other project details. The westerly neighbor testified
that the height of the deck creates overlook issues and the setback
encroachment has an adverse impact on the use of her property. The
easterly neighbor testified in support of the appellant but
expressed concern over non-screened pool equipment. The
commissioners deliberated and on a motion from Commissioner
Carpenter, seconded by Commissioner Ashbaugh voted 5-0 to deny the
appeal. A second motion by Chairperson Stevenson, seconded by
Commissioner Multari, modified the code correction directional items
to the appellant by a vote of 5-0.

GPI 49-06: Review of the Draft South Broad Street Corridor Plan;
City of San Luis Obispo, applicant. (Continued from July 9,
2008, meeting) (Jeff Hook)
Jeff Hook noted that this was a continued meeting to discuss
Chapters 3 and 4 of the revised Draft South Broad Street Corridor
Plan. He presented slides outlining key plan components and
requested Commission direction on plan changes and additions.
Chairperson Stevenson opened the public hearing. There was no
public comment.
Commissioners provided detailed comments and directed staff to
provide additional direction, condense the form-based codes to
minimize redundancy between the eight building types, and to revise
the standards to allow greater flexibility in achieving the Plan’s
objectives. Following extended discussion and comment, and on a
motion by
Commr. Multari, seconded by Vice-Chair Ashbaugh, the Commission
continued the item to its August 27, 2008 meeting for review of
Chapters 5 and 6. The motion carried unanimously.
